By accessing or using the MITA Medical Tourism website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our website or services.

These terms constitute a legally binding agreement between you ("the User" or "the Patient") and MITA Medical Tourism ("MITA", "we", "us", or "our"). We reserve the right to modify these terms at any time, and continued use of our services constitutes acceptance of any changes.

2. Services Description

MITA Medical Tourism acts as a facilitator and coordinator between international patients and healthcare providers in Vietnam. Our services include:

• Consultation and needs assessment • Medical provider selection and appointment scheduling • Travel and accommodation coordination • Interpretation and translation services • Visa support and documentation assistance • Post-treatment follow-up and aftercare coordination

We are not a medical provider and do not practice medicine. All medical decisions and treatments are solely the responsibility of the licensed healthcare providers in our network. We do not guarantee specific medical outcomes.

3. User Responsibilities

As a user of MITA services, you agree to:

• Provide accurate, complete, and up-to-date personal and medical information • Notify us promptly of any changes to your medical condition or personal circumstances • Comply with all visa requirements and travel regulations of Vietnam • Respect the policies and procedures of our partner healthcare facilities • Be responsible for understanding the risks and benefits of any medical procedure • Ensure you have appropriate travel and medical insurance coverage • Communicate honestly about your medical history, expectations, and concerns

Failure to provide accurate information may result in cancellation of services and voiding of any agreements.

4. Booking and Payment Terms

Our booking and payment terms are as follows:

• A deposit may be required to confirm appointments and travel arrangements. The deposit amount will be communicated at the time of booking. • Full payment for medical services is due directly to the healthcare provider unless otherwise agreed in writing. • MITA service fees are separate from medical treatment costs and will be clearly communicated before booking confirmation. • All prices are quoted in USD unless otherwise specified. Additional charges may apply for special requests or last-minute changes. • Cancellation policies vary by provider. MITA will communicate the applicable cancellation policy before booking. • Refunds, if applicable, will be processed according to the specific provider's policy and MITA's terms.

International service surcharges may apply for interpretation, coordination, and related customer care services as communicated.

5. Medical Consultation and Treatment

Important considerations regarding medical consultation and treatment:

• All medical treatments are performed by licensed healthcare professionals at our partner facilities. • You are encouraged to consult with your primary care physician before traveling for medical treatment. • We provide translation of medical information but cannot guarantee medical terminology accuracy in all languages. • Medical records provided to us will be shared with treating healthcare providers with your consent. • You have the right to refuse any medical treatment or procedure at any time. • In case of medical emergencies, local emergency services will be contacted immediately. • Post-treatment care instructions must be followed as directed by the treating physician.

MITA is not liable for any adverse medical outcomes, complications, or dissatisfaction with treatment results.

6. Intellectual Property

All content on the MITA website, including but not limited to text, graphics, logos, images, videos, software, and design elements, is the property of MITA Medical Tourism or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or exploit any content from our website without our prior written consent. Unauthorized use of our intellectual property may result in legal action.

7. Limitation of Liability

To the maximum extent permitted by applicable law, MITA Medical Tourism and its affiliates, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of our services • Any medical complications, adverse effects, or unsatisfactory treatment outcomes • Delays or cancellations caused by third-party providers, natural disasters, or force majeure events • Loss of data, personal belongings, or travel documents during your trip • Any damages resulting from inaccurate information provided by you

Our total liability, if any, shall be limited to the total fees paid by you to MITA for the specific service giving rise to the claim.

8. Dispute Resolution

Any disputes arising from these Terms of Service or your use of MITA's services shall be resolved as follows:

• Informal Resolution: Parties agree to first attempt to resolve any dispute informally through direct communication within 30 days. • Mediation: If informal resolution fails, parties agree to submit the dispute to mediation by a mutually agreed mediator in Hanoi, Vietnam. • Governing Law: These terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. • Jurisdiction: Any legal proceedings shall be brought exclusively in the courts of Hanoi, Vietnam.

Nothing in this section prevents either party from seeking injunctive relief or other equitable remedies as necessary.
